Terms of Service

Welcome to MoodNode. By accessing or using MoodNode ("the Service"), you agree to be bound by these Terms of Service ("Terms"). MoodNode is a node-based visual editor for AI-powered creative workflows, hosted at app.moodnode.ai.
1. Acceptance of Terms
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 13 years of age to use MoodNode (16 in the European Economic Area, or the local minimum digital-consent age where lower). If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these age requirements and are not located in, under the control of, or a national or resident of any country or region under comprehensive U.S. embargo, nor on any U.S., EU, UK, or UN sanctions list.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Service Description
MoodNode provides:
- A canvas-based workflow editor for connecting AI model nodes
- Cloud storage for projects and generated assets via Supabase
- Integration with third-party AI providers (e.g., OpenAI, fal.ai, Replicate, Anthropic, Google)
- Optional platform credits for users who prefer not to use their own API keys
5. Bring Your Own Key (BYOK) Model
MoodNode allows you to connect your own API keys from third-party AI providers. By using BYOK:
- Your API keys are stored locally in your browser and are never sent to or stored on our servers
- MoodNode never shares your API keys with any party other than the respective AI provider
- You are responsible for all costs incurred through your API keys
- You must comply with each provider's terms of service
6. Platform Credits and Paid Plans
Some plans include platform credits that can be used for AI generation without personal API keys:
- Credits are allocated per billing cycle and do not roll over
- Credit costs per generation are documented in the application
- Unused credits expire at the end of each billing cycle
- Refunds for unused credits are not provided unless required by law
- MoodNode reserves the right to modify credit pricing with reasonable notice
Auto-renewal: Subscription plans renew automatically at the end of each billing cycle at the then-current price for that plan. You may cancel at any time from Settings → Plans before the next renewal to avoid being charged. Cancellation takes effect at the end of the current period; you retain access until that date. EU/EEA consumers retain a 14-day right of withdrawal from the date of subscription, except where you have actively used the Service (consuming credits or generating outputs) within that period, in which case the digital-content waiver under EU Consumer Rights Directive Art. 16(m) applies.
Upstream provider terms:When you use platform credits, MoodNode acts as the API caller routing your generation to the applicable AI provider (fal.ai, Google, Anthropic, OpenAI, OpenRouter, Replicate, Runway, Luma, etc.). You agree to comply with the Acceptable Use Policy of the underlying provider for any generation you initiate. Generations that violate an upstream provider's policy may be blocked, refunded, or reported to the provider.
7. Cloud Storage
- Free plan: 100 MB cloud storage (lifted to 1 GB after any credit pack purchase)
- Paid plans: Up to 100 GB depending on plan
- Storage quotas are enforced server-side
- Accounts on free tier that remain inactive for extended periods may receive a warning email before any data cleanup
Backup recommendation: While we use industry-standard cloud storage (Cloudflare R2, Supabase) with redundancy, we do not guarantee 100% data durability. Hardware failure, software bugs, third-party provider incidents, and user actions (accidental deletion, account termination) can result in data loss. You are encouraged to maintain your own backups of critical projects via the Export feature.
8. User Content and Ownership
You retain ownership of the content you create using MoodNode (workflows, prompts, generated images, videos, text, audio, and uploaded references), subject to the terms of any underlying AI provider whose model produced an output. Some upstream providers restrict commercial use of certain model outputs, retain rights in outputs, or impose other terms; MoodNode's ownership statement cannot grant rights an upstream provider does not transfer.
License you grant us: You grant MoodNode a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, transmit, display, replicate (including across data centers and backups), and create derivative works of your content to the extent necessary to operate, improve, and secure the Service, including by passing content to the third-party sub-processors listed in our Privacy Policy (Cloudflare R2, Supabase, AI providers, payment processors, email senders). This license terminates when you delete your content or account, except for residual copies in encrypted backups that rotate out within 30 days.
Reference uploads: When you upload images, video, audio, or other source material as a reference (for Style DNA, Face Swap, image-to-video, lip sync, or similar features), you represent that you have the right to do so and that the resulting outputs do not violate the privacy, publicity, biometric, or intellectual-property rights of any third party. Where a reference depicts a real person, you confirm that you have obtained any consent required under applicable law (including biometric-data consent under EU GDPR Art. 9, EU AI Act Art. 5, Turkish KVKK Art. 6, and U.S. state laws such as Illinois BIPA and Texas CUBI).
Feedback: If you submit suggestions, ideas, feature requests, or other feedback (via email, in-app forms, social channels, or community spaces), you grant MoodNode a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation or compensation to you.
9. API Key Security
Your API keys are stored locally in your browser and are never transmitted to our servers. However, you acknowledge that:
- No system is 100% secure, and you use the Service at your own risk
- You should set spending limits on your API provider accounts
- MoodNode is not liable for unauthorized use of your API keys
10. Prohibited Use
You agree not to use MoodNode to:
- Generate illegal content, including CSAM or content depicting violence against real persons
- Generate non-consensual intimate imagery, deepfakes of real persons without consent, or content that violates the publicity rights of any individual
- Harass, threaten, or defame others
- Send spam or unsolicited communications
- Attempt to reverse-engineer, decompile, or hack the Service
- Circumvent usage limits or quotas
- Use the Service to train competing AI models or scrape generated outputs at scale
- Violate any applicable law or regulation
Content moderation: MoodNode reserves the right to refuse, filter, block, or remove any content (prompts or generated outputs) that violates these Terms or applicable law, including content flagged by the safety systems of upstream AI providers. We may suspend accounts that repeatedly attempt prohibited generations. Filtering decisions are made at our discretion and the discretion of the AI providers we integrate with; we are not liable for false positives that block legitimate creative work, and we are not liable when filters fail to block prohibited content — users remain solely responsible for content they generate or upload regardless of whether automated filters caught it.
EU AI Act transparency: Users in the EU/EEA are reminded that EU AI Act Art. 50 may require labeling or watermarking of AI-generated content (especially synthetic media depicting real persons) when published in the EU. Compliance with such disclosure obligations is your responsibility when you export and publish outputs.
11. Account Termination
MoodNode may suspend or terminate your account if you violate these Terms. Upon termination, you will be given a reasonable period to export your data. You may also delete your account at any time from the Settings page.
Survival: Sections 8 (User Content and Ownership — feedback license and reference-rights representations), 12 (AI- Generated Content), 14 (Limitation of Liability), 15 (Indemnification), 18 (Governing Law), and 19 (Severability) survive termination of your account or these Terms, together with any other provision that by its nature should survive.
12. AI-Generated Content
MoodNode is a workspace that orchestrates third-party AI models (operated by providers such as fal.ai, Google, Anthropic, OpenAI, OpenRouter, Replicate, Runway, Luma, and others). AI-generated content can be inaccurate, biased, offensive, factually wrong, or otherwise inappropriate. We do not guarantee the quality, accuracy, originality, or fitness for any particular purpose of any output produced through the Service.
You are solely responsible for reviewing all generated content before sharing, publishing, or using it commercially. AI outputs may unintentionally resemble copyrighted works, trademarks, or real persons; verifying that your use does not infringe third-party rights is your responsibility, not ours. Where you upload reference images, audio, or other source material, you represent that you have the rights to do so and that the resulting outputs do not violate the rights of any third party.
No commercial guarantee: Even when an AI provider permits commercial use, model outputs are produced probabilistically and may vary between generations. Do not rely on a single output for production work without independent review.
No professional advice: AI outputs are not a substitute for medical, legal, financial, psychological, or other licensed professional advice. Do not rely on AI-generated text or imagery for decisions requiring professional judgment. If a generation produces information that resembles advice in any regulated field, treat it as creative output only and consult a qualified professional before acting on it.
13. Service Availability
MoodNode does not guarantee uninterrupted or error-free service. The Service depends on multiple third-party infrastructure providers (Cloudflare, Vercel, Supabase, Polar, and the AI providers listed above) and may be temporarily unavailable due to:
- Scheduled maintenance, with or without prior notice
- Outages, latency, or capacity constraints at any third-party provider
- Software defects, deploy issues, or rollback windows on our end
- Security incidents requiring rapid mitigation
- Force majeure events outside reasonable control
We do not offer a service-level agreement (SLA) on any plan. Credits consumed by failed generations are typically refunded automatically, but we are not liable for time, opportunity, or revenue lost while the Service or any individual model is unavailable. AI provider outages affect platform-credit users disproportionately; users on Bring-Your-Own-Key (BYOK) accounts are similarly subject to their chosen provider's availability.
14. Limitation of Liability
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI outputs. To the maximum extent permitted by applicable law, MoodNode is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, business interruption, costs incurred through third-party AI providers, or claims arising from AI-generated content. Our aggregate liability for any claim relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Mandatory consumer rights: Nothing in this Section limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any rights granted to consumers under EU consumer- protection laws (including the Unfair Contract Terms Directive 93/13/EEC and the Digital Content Directive 2019/770), the UK Consumer Rights Act 2015, or equivalent statutory consumer protections in your jurisdiction.
15. Indemnification
You agree to indemnify, defend, and hold harmless MoodNode from any third-party claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Service, content you generate or upload, your violation of these Terms, or your violation of any applicable law or third-party rights.
This indemnity does not apply to claims arising directly from MoodNode's own material breach of these Terms, our gross negligence, or willful misconduct. We will promptly notify you of any claim subject to this indemnity, allow you to control the defense and settlement (provided no settlement admits liability or imposes obligation on us without our consent), and reasonably cooperate at your expense.
16. Beta and Experimental Features
Some features may be marked "Beta," "Experimental," or "Preview." These features are provided for evaluation, may contain bugs, may behave unpredictably, and may be modified, deprecated, or removed at any time without notice. Beta features are excluded from any availability or quality expectations described elsewhere in these Terms. We may collect additional usage data on beta features to improve them.
17. Modifications to Terms
MoodNode may modify these Terms from time to time. For material changes (such as changes to fees, refund policy, dispute resolution, liability limits, or licensed uses of your content) we will provide reasonable advance notice — typically at least 30 days — by email and/or an in-service notification. Non-material changes (clarity edits, broken-link fixes, minor wording) will be reflected by updating the "Last updated" date at the top of this page. Continued use of the Service after the effective date of a change constitutes acceptance of the updated Terms; if you do not agree, your sole remedy is to stop using the Service and (if you wish) delete your account before the effective date.
17a. Copyright Complaints
If you believe content hosted on MoodNode infringes your copyright, contact us at [email protected] with: (a) identification of the copyrighted work; (b) the URL or location of the allegedly infringing content; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on the owner's behalf; (f) your physical or electronic signature. We will respond to valid notices, remove or disable access to identified content, and notify the user who posted it. We may forward complaints to upstream AI providers when relevant.
18. Governing Law and Disputes
These Terms shall be governed by applicable law. Any disputes arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation, followed by binding arbitration if necessary.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
